1. Overview
This website is operated by Home and Garden Needs LLC ("we", "us", "our"), a limited liability company organized under the laws of the State of Mississippi. These Terms of Service govern your access to and use of our website and your purchase of any products from us.
By visiting our site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering, you confirm that you meet this requirement and that the information you provide is accurate and complete.
3. Products and descriptions
We work to describe our products as accurately as we can. Product images are provided by our suppliers and are intended to represent the item; actual colour, finish and dimensions may vary slightly from what appears on your screen.
Where measurements, materials or specifications are supplied to us by a manufacturer, we pass them on in good faith. We do not warrant that every description is complete, current or error-free.
We reserve the right to change or discontinue any product at any time, and to limit order quantities.
4. Pricing and payment
All prices are shown in US dollars and are subject to change without notice. Shipping costs are calculated and displayed at checkout before you pay.
Despite our efforts, a product may occasionally be listed at an incorrect price or with incorrect information. We reserve the right to cancel or refuse any order placed at an incorrect price, and to correct the error. If we cancel an order after you have paid, we will issue a full refund.
We may also refuse or cancel any order we believe to be fraudulent, placed for resale, or in breach of these Terms.
5. Shipping, returns and refunds
Delivery timeframes, customs charges and dispatch times are set out in our Shipping Policy. Return windows, conditions and the return address are set out in our Refund Policy. Both form part of these Terms.
6. Product safety and intended use
You are responsible for using our products safely and for their intended purpose. Please read any instructions, warnings, labels or manuals supplied with a product before use, and follow them.
Some products carry specific requirements. Electric bicycles are subject to laws that vary by state and locality, including rules on where they may be ridden, helmet use, minimum age and registration; it is your responsibility to check and comply with the law where you live. Craft products containing small parts are not suitable for young children and require adult supervision. Personal care and sleep products are general wellness items, are not medical devices, and are not intended to diagnose, treat, cure or prevent any condition.
7. Acceptable use
You agree not to use the site to break any law, infringe anyone's rights, transmit malicious code, interfere with the site's operation or security, scrape or harvest data, or impersonate another person.
8. Intellectual property
The content on this site, including text, layout and graphics, is owned by us or our licensors and is protected by applicable law. You may not reproduce or distribute it commercially without our written permission.
9. Third-party links
Our site may link to third-party websites we do not control. We are not responsible for their content, products or practices, and linking to them is not an endorsement.
10. Disclaimer of warranties
Except where prohibited by law, the site and the products sold through it are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the site will be uninterrupted, secure or error-free.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, Home and Garden Needs LLC and its members, officers and agents will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the site or any product purchased from us. Our total liability for any claim will not exceed the amount you paid for the product giving rise to that claim.
Nothing in these Terms limits any liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence.
12. Indemnification
You agree to indemnify and hold harmless Home and Garden Needs LLC from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your misuse of a product.
13. Governing law and venue
These Terms are governed by the laws of the State of Mississippi, without regard to its conflict of law rules. Any dispute arising from these Terms or your use of the site will be brought exclusively in the state or federal courts located in Mississippi, and you consent to the jurisdiction of those courts.
14. Changes to these Terms
We may update these Terms from time to time. The revised version takes effect when posted on this page, and the "Last updated" date will change. Your continued use of the site after that constitutes acceptance.
15. Severability and entire agreement
If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the rest will remain in effect. These Terms, together with our Refund, Shipping and Privacy policies, constitute the entire agreement between you and us.
